SMS Text Marketing Terms & Conditions

By opting in to receive marketing and advertising text (SMS) messages from Blaze Credit Union (“Blaze”) through our third-party agent or authorized service provider, you agree to the following Blaze SMS Text Marketing Messaging Terms and Conditions:

1. You agree Blaze may use an electronic record to document your consent. Blaze may determine in its sole discretion what information we make available to you through the text messaging service. Message frequency may vary. Blaze may send any text (SMS) message, either directly, or via a third-party agent or authorized service provider, in order to deliver it to you.
2. You represent that you are the subscriber or user of the phone number provided. If there are changes to your phone number, you agree to promptly inform us to prevent or limit Blaze from inadvertently communicating with someone else. Upon your notice or our knowledge of reassignment, we will cease marketing communications to the reassigned number. You agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, costs and expenses (including reasonable attorneys’ fees) arising from your provision of a phone number that is not your own or your violation of applicable federal, state or local law, regulation or ordinance. Your obligation under this paragraph shall survive termination of these Blaze SMS Text Marketing Messaging Terms and Conditions.
3. For further help or information, send a return text with the word “HELP”. You can also opt-out at any time by replying “STOP” to any text (SMS) message you receive. We will honor opt-out requests within a reasonable time, not to exceed 10 business days. An opt-out request for the phone number provided applies to marketing texts. Revoking your consent to receive automated marketing calls or text (SMS) messages from Blaze for marketing and advertising purposes does not affect any consent you provided to receive automated text messages related to a specific transaction (for example, a loan application), where permitted by applicable law. Any terms of these Blaze SMS Text Marketing Messaging Terms and Conditions that has application to events following your opt-out will continue to apply.
4. Your consent to receive the Blaze marketing text (SMS) messages is not a condition to receive any Blaze product or service. There is no separate fee for use of the Blaze marketing text (SMS) messaging services, but you are responsible for any and all charges and fees otherwise associated with text messaging imposed by your communications service provider. Standard message charges may apply.  Please contact your communications service provider for more information.
5. Data obtained from you in connection with the Blaze marketing text (SMS) messages may include your phone number, wireless provider name, date, time, message content, and related information to provide and manage the message and managing program, prevent fraud, and comply with applicable laws. Blaze may use this information in accordance with its Privacy Policy.
   
6. For your protection, Blaze will never ask you to send sensitive data (such as passwords, Social Security numbers, or payment details) over text messages. Please contact us at 651.215.3500 directly if you receive a suspicious request.
7. Blaze may cancel or terminate the marketing text (SMS) messaging service at any time with or without notice to you. Blaze will not be liable for any delays or failure in the receipt of any marketing text messages. Blaze makes no warranty regarding availability or reliability of the marketing text (SMS) messaging service and you acknowledge and agree that delivery is subject to effective transmission from your communications service provider.
8. You agree that any claim, dispute, action or litigation based hereon, relating to or arising out of these Blaze SMS Text Marketing Messaging Terms and Conditions, shall be brought and maintained exclusively via arbitration. Any party seeking to pursue an action to arbitrate shall give written notice to the other party of such election that summarizes in sufficient detail the basis of the dispute at least ten (10) days before bringing an arbitration action. The dispute shall be submitted for arbitration with JAMS in accordance with its Comprehensive Arbitration Rules and Procedures. Such arbitration shall be conducted, unless otherwise agreed by the parties, by a single arbitrator, who shall be a former judge, in Hennepin County, Minnesota. The award of the arbitrator may be confirmed or enforced in any court of competent jurisdiction. You expressly waive any objection of venue and jurisdiction, including but not limited to arguments that such litigation any action has been brought in an inconvenient forum.
9. BLAZE WISHES TO TIMELY RESOLVE ANY DISPUTES. ACCORDINGLY, TO THE EXTENT ALLOWED UNDER APPLICABLE LAW, YOU AGREE THAT ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE BLAZE SMS TEXT MARKETING MESSAGING TERMS AND CONDITIONS SHALL BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OTHERWISE SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
10. TO THE EXTENT ALLOWED UNDER APPLICABLE LAW, BLAZE AND YOU AGREE TO WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING TO ENFORCE OR DEFEND ANY RIGHTS UNDER THESE BLAZE SMS TEXT MARKETING MESSAGING TERMS AND CONDITIONS.
11. TO THE EXTENT ALLOWED UNDER APPLICABLE LAW, YOU FURTHER HEREBY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AND AGREE THAT ANY AND ALL DISPUTES ARISING FROM THESE BLAZE SMS TEXT MARKETING MESSAGING TERMS AND CONDITIONS SHALL BE RESOLVED ON AN INDIVIDUAL BASIS.
12. Blaze may change these Blaze SMS Text Marketing Messaging Terms and Conditions at any time, without notice, except as required by law. Such updated Blaze SMS Text Marketing Messaging Terms and Conditions shall be effective upon the “last updated date” when posted to Blaze’s website. Blaze will advise you if these Blaze SMS Text Marketing Messaging Terms and Conditions change, and you agree to review the Blaze SMS Text Marketing Messaging Terms and Conditions regularly to ensure you are aware of any changes. Your continued use of the marketing text (SMS) messaging service after the Blaze SMS Text Marketing Messaging Terms and Conditions have changed shall constitute your acceptance of the new Blaze SMS Text Marketing Messaging Terms and Conditions.
